Short sale tip:  If you are short selling an investment property this is something to look out for.  The short sale lender and the mortgage insurance company will be running a credit report on you.  If they see that you have a new mortgage they will play hardball with you.  The lender/mortgage insurance company may ask for a significant seller contribution at closing if they see that you recently obtained a new mortgage. 

The short sale lender will see a refi loan as a new loan.   New loan means to them that if you can get a new loan why should they approve a short sale.  If you had a refi loan prior to entering into a short sale situation this may come back to bite you.  If you have done a refinance loan on your primary residence because you are looking to save your cash flow please bring it to the attention of your real estate agent.  Your agent should know so the agent can fight for you to let the short sale negotiator know so that common sense can hopefully prevail.

Mortgage Debt Forgiveness Act

You may owe federal income taxes in 2013 if you have a short sale or foreclosure. The Act runs through the end of 2012 so if you are sitting on the fence this something to think about. Don’t wait for a Lis Pendens (foreclosure notice) before you decide to do a short sale.
